These model clauses are to assist Australian Government entities to manage and mitigate FOCI risks in procurement. They are designed to support a range of procurement activities, including tendering, contracting and contract management. The model clauses are optional, and organisations should select the relevant clauses that they wish to include in their procurement documents based on FOCI risk for that procurement activity. Organisations can use the model clauses to embed practical safeguards into procurement arrangements and respond to changes in the supply chain.

These model clauses complement the Department of Home Affairs’ FOCI Risk Assessment Guidance. Use of the model clauses can support supply chain security best practice and assist non-corporate Commonwealth entities in meeting their obligations under the Protective Security Policy Framework (PSPF). This includes PSPF direction 001-2024 which requires Australian Government entities to identify and appropriately manage FOCI risk as it relates to procurement and maintenance of technology assets.
