The Skills Guarantee leverages Australian Government major project procurement to help train the next generation of skilled workers. It is a key commitment under the Australian Government’s Secure Australian Jobs Plan.
The Skills Guarantee applies to direct Australian Government procurements subject to the CPRs in the building and construction and maintenance services (Construction) and information and communications technology (ICT) sectors, where the estimated individual value is $10 million or more.
The Skills Guarantee PCP provides guidance for parties engaging in relevant Australian Government-funded projects, including further detail on the types of procurements the Skills Guarantee PCP applies to.
Using the Skills Guarantee PCP Model Clauses ensures that Approach to Market processes and Contracts comply with the Skills Guarantee PCP requirements.
Please refer to the following versions based on your procurement timeline:
- Skills Guarantee PCP Version 1 and Model Clauses Version 1 for Approach to Market, Standing Offer documentation or Contracts from 1 July 2024 to 30 September 2025.
- Skills Guarantee PCP Version 1.2 and Model Clauses Version 1.1 for Approach to Market, Standing Offer documentation or Contracts from 1 October 2025.
The Skills Guarantee PCP Model Clauses Version 1.1 contain:
- Approach to Market clauses for a Major Construction Project
- Contract clauses for a Major Construction Project
- Approach to Market clauses for a Flagship Construction Project
- Contract clauses for a Flagship Construction Project
- Approach to Market clauses for a Major ICT Project
- Contract clauses for a Major ICT Project
- Approach to Market clauses for a High-Value ICT Project
- Contract clauses for a High-Value ICT Project
The Skills Guarantee PCP Model Clauses are available on the Australian Skills Guarantee website at: Australian Skills Guarantee Model Clauses - Department of Employment and Workplace Relations, Australian Government (dewr.gov.au).
The Australian Skills Guarantee Model Clauses can be included by Commonwealth entities in Approach to Market, Contract or Standing Offer documentation, as relevant, to give effect to the requirements of the Skills Guarantee PCP.
Commonwealth entities can modify and adapt the clauses to ensure consistency with their Approach to Market, Contract or Standing Offer documentation, provided that the requirements of the Skills Guarantee PCP are met. Commonwealth entities should ensure that, where they modify and adapt the Model Clauses, that they still meet the mandatory requirements set out in the Skills Guarantee PCP.
Any terms that are capitalised may need to be changed to align with the Contract terminology.
Commonwealth entities and tenderers should refer to the relevant Skills Guarantee PCP to ensure that all requirements of that policy are met and for further information on how the policy applies.
