Draft Head Agreement for whole of government Cloud Panel

Firstly, thank you for the constructive feedback that we have received to date in relation to John Sheridan’s post about the Cloud Procurement Discussion Paper (Discussion Paper). I would like to continue to encourage agency and industry feedback on this document.

Further to the circulation of the Discussion Paper, we are seeking feedback on the content of the draft Head Agreement for a whole of government Cloud Panel*.

Finance recognises that cloud services are constantly evolving. Through simplifying the Head Agreement and Contracts, we are seeking to improve flexibility and reduce burden on industry. I invite you to comment on the Head Agreement, in particular, on the following:

  • Do you have any suggested changes to the content of the Head Agreement?
  • Do you have any suggestions on clauses that we should consider adding to the Head Agreement?

We are seeking feedback by 5.00pm (AEST) Tuesday, 19 August 2014.

* The proposed draft Head Agreement may change following consultation, for that reason interested suppliers should not rely on the finality of this document. The final Head Agreement will be provided with the approach to market documentation provided via AusTender when the tender is released.

Thanks for the opportunity to comment. It would be helpful to include a clause about the acceptance of deliverables for clarity (e.g. the pay on time or pay interest policy applies for accepted goods/services, not just on receipt date of the invoice). Something along the lines of 'services will require a written acceptance from the Commonwealth, unless otherwise stated in work order' would alert both Commonwealth buyers and suppliers to think about what acceptance procedures they'll need before they start work.
