Agencies that are subject to the Lands Acquisition Act 1989 (LAA)  must dispose of property in accordance with the provisions in Part X of the Act.
The Minister for Finance is responsible for approving a proposed disposal in terms of the Commonwealth Property Disposals Policy, and for authorising the disposal under the LAA.
Agencies need to fully develop any priority sale proposals before their Minister recommends the sale to the Minister for Finance. However, agencies have no authority to make a binding commitment prior to the Minister for Finance approving a sale in terms of the disposals policy.
