Appendix A. Five-yearly reviews
Commonwealth regulation is required to be reviewed regularly. Regulation that has an impact on business or the not-for-profit sector, and is not minor or machinery in nature, is to be reviewed periodically unless it is subject to:
- the review provisions in the Legislative Instruments Act 2003, or
- other statutory review provisions.
A screening process will be used to identify those regulations that should be reviewed each year, commencing in 2012 when the first of these reviews will be required. The review should take into account the nature of the regulation and its perceived performance.
Agencies will communicate their review schedule (all regulation subject to review in the upcoming year) and strategies in their Annual Regulatory Plan. Five-yearly reviews will also be published on the OBPR’s online RIS register.
