FMA Delegations

Delegation of powers and functions under FMA Legislation

Under the Financial Management and Accountability Act 1997 (FMA Act) and Financial Management and Accountability Regulations 1997 (FMA Regulations), a number of the powers and functions of the Finance Minister have been delegated to agency Chief Executives.

Delegates must comply with the directions contained in the delegation instruments.

Updated on 28 March 2013, this delegation incorporates five amendments (Amendment No. 1 2011, Amendment No. 1 2012, Amendment No. 2 2012, Amendment No. 3 2012 and Amendment No. 1 2013) to the original delegation issued on 18 November 2010.

Amendments to the Delegation

Amendment No. 1 2013 - amended the delegation to reflect Administrative Arrangements Order changes made by the Governor-General on 25 March 2013.  This delegation chances the name of one Department of State: the Department of Industry, Innovation, Climate Change, Science, Research and Tertiary Education (DIICCSRTE). This amendment only applies to DIICCSRTE.

Issued on 25 March 2013:

Amendment No. 3 2012 – amended the delegation to provide the Electoral Commissioner of the Australian Electoral Commission with the power to open and maintain official bank accounts outside Australia.

Issued on 3 October 2012:

Amendment No. 2 2012 – amended the delegation to provide the Chief Executive of the Department of Immigration and Citizenship with the power to open and maintain official bank accounts outside Australia.

Issued on 30 May 2012:

Amendment No. 1 2012 - amended the delegation to reflect Administrative Arrangements Order changes made by the Governor-General on 14 December 2011.  This delegation chances the names of two Departments of State: the Department of Industry, Innovation, Science, Research and Tertiary Education (DIISRTE) and the Department of Regional Australia, Local Government, Arts and Sport (DRALGAS). This amendment only applies to DIISRTE and DRALGAS. 

Issued on 27 February 2012:

Amendment No. 1 2011 - amended the delegation to reflect the changes to the Department of Human Services (DHS). This amendment only applies to DHS.

In addition Departmental Secretaries have also been delegated some of the Finance Secretary’s powers under the FMA Act and the FMA Regulations to assist them to monitor the financial position relating to the provision of financial reports and budget estimates of small agencies within the portfolio of their responsible Minister(s).
